Web Design & SEO Services Terms and Conditions

• All sales are final and a "No Refund" Policy is in effect.
• Any prices quoted on this web site are advisory only and may be modified at any time.
• For most services, payment is expected upon completion of service although some services may require payment in advance.
• Search Engine Optimization (SEO) is not guaranteed and must be paid for in advance. If the SEO is not successful or does not meet the expectations of the client, there is no refund.
• Limitation of Liability: Walton Street Web Design is in the business of Macintosh consulting and Web Design. Any advice offered is to be used at the sole discretion of the person being offered the advice. Walton Street Web Design is not responsible for any actions or consequences resulting from bad advice. Once paid for, Walton Street Web Design does not own any software or files produced by it and thus is not liable for any legal actions or consequences that may result from the content of said files.

WEB HOSTING ACCEPTABLE USE POLICY

This Acceptable Use Policy sets forth guidelines relating to the types of content that you may upload to the web servers under your agreement with Walton Street Web Design for web hosting services (the "Services"). Walton Street Web Design may remove any materials that, in its sole discretion, may be illegal, may subject it to liability, or which may violate this Acceptable Use Policy. Walton Street Web Design will cooperate with legal authorities in the investigation of any suspected or alleged crime or civil wrong arising from any use of the Services. Your violation of this Acceptable Use Policy may result in the suspension or termination of either your access to the Services and/or your account or other actions as detailed in the Web Hosting Agreement.

1. Acceptable Use
   1. Using the Services to transmit or post any material that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.
   2. Using the Services to harm, or attempt to harm, minors in any way.
   3. Using the Services to transmit or post any material that harasses, threatens or encourages bodily harm or destruction of property.
   4. Using the Services to make fraudulent misrepresentations or offers including but not limited to offers relating to "pyramid schemes" and "Ponzi schemes."
   5. Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Walton Street Web Design or another entity's computer software or hardware, electronic communications system or telecommunications system, whether or not the intrusion results in the corruption or loss of data.
   6. Using the Services to transmit or post any material that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying and/or distribution of copyrighted material, the digitization and distribution of photographs from magazines, books, music, video or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
   7. Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
   8. Reselling the Services without the prior written authorization of Walton Street Web Design.
   9. Using the Services for any activity that adversely affects the ability of other people or systems to use the Services or the Internet. This includes but is not limited to "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited.
2. Revisions to This Acceptable Use Policy
   1. Walton Street Web Design may revise, amend or modify this Acceptable Use Policy at any time and in any manner.
3. Web Hosting Billing Policy
   1. By using my credit / debit card for paying for web hosting I hereby authorize Walton Street Web Design to charge my card on a recurring basis per the plan I selected unless I cancel in writing. I agree not to dispute any charges from Walton Street Web Design.

WEB SITE PACKAGES

Any websites billed on a monthly basis (vs a flat fee) fall under the following rules:

• $49.95, $74.95, and $99.95 a month plans all require 1 year contract. After 1 year plans may be cancelled at any time. Clients are responsible for providing Walton Street Web Design will all text and pictures to be included in their website. After a client provides content but if content is uncompleted, not proofread, or changed later the further updates to the content may constitute as a “basic web site” update OR an additional fee may be applied. Client may request a full refund within 7 days of purchasing the product – after that a no refund policy is in effect. Should client attempt to cancel their plan early Walton Street Web Design reserves the right to bill a client’s credit card for the entire remaining balance of the year. Each page will have a maximum of 500 words per page.
• Up to two web site package updates are included each month, however these are basic updates and the definition of what's included is up to the sole discretion of Walton Street Web Design.
• By enrolling in any web site package the client authorizes Walton Street Web Design for bill their credit card on an automatic basis and agrees not to dispute any charges.
